Kolby AI Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Kolby AI’s software, platform, APIs, websites, and related tools (the “Service”). “Kolby,” “we,” “us,” and “our” refer to Kolby AI LLC and its affiliates. By using the Service, you agree to these Terms.

1. Access and Use

1.1 Provision of Access

Kolby grants you a limited, non-exclusive, non-transferable license to access and use the Service for legitimate business communication, sales coaching, analytics, and call guidance.

1.2 Inputs & Suggestions

You may provide audio, transcripts, and other inputs (“Inputs”). The Service returns AI-generated feedback and analytics (“Suggestions”). You are responsible for verifying Suggestions before acting on them.

1.3 Model Training

We do not use customer Content for base model training unless expressly opted in under a separate agreement.

1.4 Redaction of Sensitive Data

Kolby uses automated data masking and real-time redaction filtering to block sensitive information—such as credit card numbers, Social Security numbers, and dates of birth—from being transcribed or stored in any form.

1.5 Use Restrictions

• Do not resell or share access without authorization.
• Do not use the Service to collect or transmit illegal or unauthorized data.
• Do not reverse-engineer or attempt to extract source code or model weights.
• Do not use the Service to train a competing model or product.

1.6 Beta Features

Experimental or preview features are offered “as is,” may change or end at any time, and may have additional terms.

2. Eligibility

You must be at least 18 years old (or of legal age in your jurisdiction) and legally able to enter into contracts.

3. Account Registration

Provide accurate account information and keep it current. You are responsible for maintaining credential security and for activity on your account. Report unauthorized use to support@kolbyai.com.

4. Payment Terms

4.1 Pay-As-You-Go Model

Kolby AI operates on a metered, pay-as-you-go basis. Usage is billed according to the number of minutes or interactions processed. There are no recurring subscriptions unless explicitly stated in an enterprise order form.

4.2 Activation and Setup Fees

Some accounts may include a one-time activation or setup fee disclosed at checkout or in the applicable order form.

4.3 Pricing

Current rates are shown on our pricing page. We may update pricing with notice. Taxes and payment-processor fees (if any) are your responsibility.

4.4 Payment Processing

Payments are securely processed through third-party processors such as Stripe. By submitting payment information, you authorize us to charge the amounts owed for your usage.

4.5 Billing Cycles

Usage charges may be billed immediately after each call, daily, or monthly depending on your account type (individual or enterprise). Metered usage invoices are due upon receipt unless otherwise specified.

4.6 Delinquency

Late or failed payments may result in suspension of Service. We may recover reasonable collection costs and fees permitted by law.

5. Ownership & Licenses

Kolby AI and its licensors retain all intellectual-property rights in the Service. You retain rights to your own Inputs and resulting Content. By using the Service, you grant Kolby a limited license to process and host your Content solely to operate and improve the Service.

6. Third-Party Services

The Service may depend on external providers (e.g., telephony, transcription engines, billing). Your use of those services is governed by their own terms.

7. Communications

Kolby may send you service-related and promotional messages. You can unsubscribe from marketing at any time; system notifications are still required for essential account operations.

8. Changes to Terms

We may revise these Terms periodically. Notice of material updates will be provided via email, in-app message, or this page. Continued use of the Service constitutes acceptance of revised Terms.

9. Termination

You may stop using the Service anytime. We may suspend or terminate access for breach, abuse, or legal compliance. Sections 5 through 17 survive termination.

10. Service Changes

We may enhance or retire features at any time. If we permanently discontinue a paid feature, you will receive a pro-rated refund for any unused prepaid balance tied to that feature.

11. Copyright Complaints

For DMCA notices, email support@kolbyai.com with all required details (signature, work identification, infringing URL, contact info, and sworn statement).

12. Privacy

Kolby AI uses strong encryption and automatic redaction filters to prevent sensitive information from being stored or displayed in transcripts. We comply with applicable data-protection laws. See our Privacy Policy for complete details.

13. Indemnity

You agree to indemnify and hold Kolby AI harmless from any claims arising out of your misuse of the Service or violation of these Terms.

14. Warranty Disclaimer

THE SERVICE IS PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ERROR-FREE OR UNINTERRUPTED OPERATION, OR PERFECT ACCURACY OF AI OUTPUTS OR TRANSCRIPTIONS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT ALLOWED BY LAW, KOLBY AI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OR LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY IN ANY SIX-MONTH PERIOD SHALL NOT EXCEED THE AMOUNT YOU PAID TO KOLBY AI FOR THAT PERIOD.

16. Dispute Resolution

Disputes will be resolved by binding arbitration under the rules of the American Arbitration Association unless prohibited by law. You waive the right to class actions.

17. Miscellaneous

These Terms represent the entire agreement between you and Kolby AI regarding the Service and supersede prior understandings. If any provision is unenforceable, the remainder remains in effect. Kolby’s failure to enforce a term is not a waiver of its rights.
